THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS: Section 1: Title 9 of The Philadelphia Code is hereby amended as follows: TITLE 9. REGULATION OF BUSINESSES, TRADES AND PROFESSIONS * * * CHAPTER 9-630. SEVENTH DISTRICT COMMERCIAL BUSINESS HOUR RESTRICTION. (1) Definitions . * * * (b) Fitness Facility. A commercial establishment primarily engaged in offering space, equipment, and programs for physical exercise, conditioning, and general health and wellness activities. Typical activities include cardiovascular training, strength training, group fitness classes, and similar physical activities. Fitness Facilities do not include medical treatment facilities, sports stadiums, or youth-oriented instructional programs that are regulated under separate provisions. * * * (2) Prohibited Conduct. Notwithstanding any other provision of this Code, no Commercial Establishment shall be open to the public between 11 p.m. and 6 a.m. within the Seventh Councilmanic District. (a) Exceptions. (.1) A Fitness Facility may be open to the public beginning at 5:00 a.m. (3) Penalties.
